(Oral) At this stage, counsel for the respondent, as per the instructions received from the respondent, submits that he has no objection, if the present application is allowed and the divorce petition is transferred from Amritsar to Family Court (Camp Court), Batala, District Gurdaspur. Counsel for the parties heard.
It is pertinent to mention that on account of the matrimonial dispute, the applicant had filed one complaint under Section 12 of Protection of Women from Domestic Violence Act, which has since been decided ex parte by the courts at Batala. However, no interim maintenance has been paid by the respondent. Besides the same, the applicant has also filed an appeal i.e. CRA-247-2023, titled "Kanwaljit Kaur v/s Harpreet Singh and others", which is also pending in the courts at Gurdaspur. Considering the aforesaid circumstances, more particularly, the Sonu 2025.05.21 15:08 I agree to specified portions of this document P&HHC
TA-559-2024 statement so made by the counsel for the respondent, the transfer application is hereby allowed and the petition under Section 13 of Hindu Marriage Act titled "Harpreet Singh v/s Kawaljeet Kaur", stands transferred from the Family Court, Amritsar, to the Court of competent jurisdiction at Family Court, Batala, District Gurdaspur. The requisite record of the aforesaid case be sent by the Family Court, Amritsar, to the District and Sessions Judge, Gurdaspur.
Learned District and Sessions Judge, Gurdaspur, shall assign the said petition to the Family Court (Camp Court), Batala. Even, the parties are directed to appear before the Family Court (Camp Court), Batala, within a period of one month from today onwards.
