-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.226 dated 07.06.2019 under Sections 379-B, 34, 412 IPC (Section 25 of Arms Act added later on) registered at Police Station Rai, District Sonipat.

Counsel for the petitioner herein would contend that petitioner is in custody since 07.02.2020. Investigation is complete and challan has already been presented in the Court. It is further contended that the coaccused has already been granted bail by this Court vide order dated 14.08.2020 passed in CRM-M No.14709 of 2020 and therefore, on the basis of parity seeks similar relief to the petitioner. Learned counsel appearing for the respondent-State opposes the regular bail, who argues that no ground is made out for concession of regular bail.

I have heard learned counsel for the parties.

CRM-M No.22283 of 2020 (O&M) -2Since the challan has already been presented and the coaccused has already been granted bail by this Court, coupled with the fact that the trial is likely to take some time to conclude as due to COVID-19 situation, Courts are not working at their full strength, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
