The Revisional Court concurred with the order passed by the Trial Court dismissing the complaint filed by the petitioner holding that the complaint is apparently a counter-blast of the case registered against the petitioner for offence punishable under Section 306 read with Section 34 IPC for abetment to suicide of her husband. 3.
Apart from this, it will also be apt to notice herein that in the connected CRM-A No.768-MA of 2016 arising out the complaint case wherein the present petitioner was accused of having abetted suicide of deceased Sunil Kumar, this Court after referring to the suicide note left by Sunil Kumar has held that it was Sunil Kumar only who has taken his life and the petitioner stands acquitted in the said case.
4.
Ld. Counsel for the petitioner has not been able to point out any circumstance to make out a case to exercise jurisdiction under Section 482 Cr.P.C. He has not been able to show any evidence that could constitute prima facie case against the respondents for summoning them for offence punishable under Section 302/34 IPC.
5.
Consequently, the present petition is dismissed being without any merit.
