RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.75 dated 11.02.2018 registered under Sections 307, 34 IPC and Section 25 of the Arms Act, 1959 at Police Station Badshahpur, District Gurugram.
According to the prosecution, in the morning of 11.02.2018, petitioner and his accomplice, namely, Ravi, Sandeep, Kala, Narender @ Tillu fired two shots upon complainant Vijay, which hit him. As a result of which, complainant fell down on the road from his scooty. Learned counsel for the petitioner contends that main accused is Narender @ Tillu. Petitioner has falsely been implicated being closely related to the main accused. No recovery of any weapon was effected from any of the accused. Petitioner is in custody since 16.03.2018. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
