(ORAL) The petitioner herein seeks the issuance of a direction to respondent No.2 for marking the enquiry of the criminal case arising out of FIR bearing No.66 dated 17.04.2020 registered at Police Station Behal, District Bhiwani, under Sections 377, 120-B and 506 read with Section 34 IPC and Section 3(2) of the SC and ST Act to CBI/State Crime Branch to conduct fair, impartial and proper investigation in respect thereof and also to punish respondents No.3 to 5 who are conniving with respondents No.6 and 7 and are supporting them.

Mr. S.S.Pannu, learned Deputy Advocate General, Haryana, has joined the proceedings on behalf of respondents No.1 to 5 in this case in pursuance of the copies of this petition having been SEEMA SHARMA 2021.07.13 17:10 I attest to the accuracy and integrity of this document

sent to the respondent-State in advance. He, on the instructions from SI Sunder Pal, Police Station Behal, District Bhiwani, submits that the cancellation report qua the subject FIR has already been prepared and dispatched to the higher officers on 20.02.2021. At this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition while submitting that in view of the above-discussed submissions as made by learned State counsel, the petitioner would be availing the other efficacious and appropriate legal remedy, as may be admissible/permissible to him. Learned State counsel has no objection for the same. Accordingly, the petition in hand stands dismissed for having been withdrawn.
