Sarrukh seeks grant of regular bail in respect of a case registered against him vide FIR No.363 dated 9.8.2018 under Sections 419, 420, 467, 468, 471 and 120-B of Indian Penal Code, 1860 at Police Station Shivaji Nagar, District Gurugram. The allegations, in nutshell, are that the petitioner in collusion with agents and officials of office of ADC/SDM, Gurugram had obtained a driving licence bearing No.HR-26-20160013125 by affixing forged documents i.e. PAN card, Gas connection, Bank Account, school certificate etc. and that thereafter an attempt was made by the accused to destroy the forged documents.

Notice of this petition was issued to the State. The learned counsel for the petitioner has submitted that he has falsely been implicated in the present case and that in any case challan has already been presented and the petitioner is no longer required for any investigation or interrogation and in these circumstances, he may be KAMAL KUMAR 2018.10.11 17:01 I attest to the accuracy and integrity of this document

On the other hand, the learned State counsel has submitted that in view of the nature of allegations and concrete documentary evidence against the present petitioner, no case for grant of bail is made out.

Having considered the rival submissions addressed before this Court and bearing in mind the fact that the case is based mainly on documentary evidence, which had already been collected by the police and that challan has already been presented, no useful purpose would be served by further detaining the petitioner behind bars. The present petition, as such, is accepted and the petitioner Md. Sarrukh is ordered to be released on bail subject his furnishing bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned. This petition stands accepted accordingly.
