JASWANT SINGH, J (ORAL) Prayer is for grant of anticipatory bail in case FIR No.13 dated 16.5.2015 under Sections 420/176/120-B IPC and 13 (1) read with Section 13 (2) of the Prevention of Corruption Act, 1988, Police Station Vigilance Bureau, Phase-1, Punjab at Mohali.

As per the allegations, the petitioners are residents/proprietors of Village Phongota Teeka Shamlat, District Gurdaspur and are alleged to have been one of the beneficiaries, who received compensation for the acquired land measuring 9000 kanals for construction of Ranjit Sagar Dam. It is alleged that most of the beneficiaries have received compensation for non-existing land based on incorrect revenue record. Learned counsel contends that the entire compensation was awarded after a contest with the Gram Panchayat and the Government under

CRM-M- 43086 of 2014 #2# Sections 18 and 30 of the Land Acquisition Act, which has attained finality and, therefore, no offence is made out against the petitioners. Learned state counsel, on instructions from Inder Pal SinghInspector, Vigilance Bureau, Phase-1, Mohali concedes that the investigations are over and the challan has been presented before the Court of Special Judge, Mohali.

In view of the above, it is apparent that the custody of the petitioners is no longer required.

Accordingly, the present petition is allowed and it is ordered that in the event of arrest of the petitioners, they shall be released on bail by the learned trial Court to its satisfaction.
