NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for transfer of Petition bearing Mnt. 201/2021 under Section 125 Cr.P.C. titled as 'Rupinderjit Kaur and another Vs. Manpreet Singh', pending in the Court of learned Family Court, Ludhiana to a Court of competent jurisdiction at Kapurthala.

Perusal of the order sheets shows that vide order dated 08.05.2023, notice of motion was ordered to be issued by a co-ordinate Bench of this Court, subject to deposit an amount of Rs.35,000/- by the petitioner by way of demand draft with the Registry, to be given to the respondent-wife on her appearance before this Court. Thereafter, the matter was listed for hearing on 25.09.2023, on which date the Registry had reported that the aforesaid order had not been complied with by the petitioner and learned proxy counsel appearing for the petitioner had prayed for an adjournment as she was not aware about the facts of the present case.

CRM-M-23042-2023 -22024:PHHC:037974 Today, again the Registry has reported that notice could not be issued to the respondent as the demand draft amounting to Rs.35,000/- in terms of order dated 08.05.2023 has not been deposited by the petitioner, so far. Even, none has put in appearance on behalf of the petitioner, despite the case having been called twice. Therefore, it can safely be presumed that the petitioner or his counsel is no more interested in pursuing the present revision petition. In view of the above, the present petition is dismissed for non-prosecution.
