On the instructions of ASI Sukhjinder Singh, it has been informed that the petitioner has joined the investigation and challan qua the co-accused of the petitioner has already been submitted. Since the petitioner was not arrested from the spot, his identity and culpability will certainly be a debatable issue during the course of trial. The petition is allowed and interim order dated 17.12.2014 is hereby made absolute subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not commit the similar offence, of which he is accused of, during the pendency of the trial.
