Through the instant petition, the petitioner has sought the concession of anticipatory bail, in FIR No.73 dated 30.05.2023, under Sections 379-B, 120-B of the IPC, registered at P.S. City-I Malerkotla, District Malerkotla.

This Court, through drawing an order on 06.05.2024 upon the instant petition, besides issuing notice, directed the petitioner to join the investigation and also granted him interim bail. 3.

However, despite grant of the concession (supra), neither the petitioner joined the investigation, as informed by the learned State counsel, nor anyone caused representation on his behalf before this Court, on the last date of hearing, i.e. 23.05.2024. Consequently, purely in the interest of justice, the instant petition was ordered to be listed today. DEVINDER YADAV 2024.05.30 09:06 I attest to the accuracy and authenticity of this order/judgment

Today, the learned State counsel has, on instructions imparted to him by A.S.I. Karanjit Singh, informed this Court that, although the petitioner joined the investigation on 27.05.2024, however, he did not cooperate with the investigating officer, inasmuch as, the snatched mobile and the motorcycle used in commission of the said crime, have not been recovered by him.

Taking into account: (i) the conduct of the petitioner, vis-avis, his failure to join the investigation at the first instance, despite him being bestowed interim relief, and thereafter, despite joining the investigation, his failure to cooperate with the investigating officer; and (ii) the gravity of allegations levelled against him; this Court is not inclined to grant the extraordinary relief of anticipatory bail to the petitioner.
