Petitioners have filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 422 dated 1.7.2015 under Section 392, 120-B, 34 of the Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959, registered at Police Station Sadar Rohtak, District Rohtak. Learned counsel for the petitioners has submitted that petitioners have been falsely involved in this case. Petitioners were not present at the spot when the alleged canter was taken away by the accused.

Learned State counsel, on the other hand, has opposed the petition and has submitted that during investigation, statement of accused Ramesh was recorded and as per the said statement, petitioners had also participated in the crime. Petitioners are required for custodial interrogation.

Crl. Misc. No. M-42991 of 2015 -2complainant along with other cattle traders had started from Abohar Mandi, Punjab towards Ghaziabad. When they reached near village Garhi Kheri, an ECO Vehicle stopped their canter. The persons sitting in the said vehicle took away canter No. HR-572056 along with the cattle. The assailants also snatched mobile phones from the complainant party and ` 8,000/-. In the present case, the allegations levelled against the petitioners are serious in nature. Petitioners and their co-accused had planned to loot the vehicle carrying cattle. Petitioners are required for custodial interrogation.

Dismissed.
