The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Poonam alleging that her house had been sold by Chander Parkash in the name of his wife by producing his aunt as impersonator.

Counsel for the petitioner has submitted that Mayal Yadav, wife of Chander Parkash has been granted the concession of pre-arrest bail. The petitioner seeks parity with Mayal Yadav. I have considered the facts and circumstances of the case and gone through the record. The property of complainant Poonam has been sold by Chander Parkash, who is real brother of the petitioner. He was instrumental in getting the property of the complainant transferred in the name of wife of Chander Parkash. The said property appears to have been further alienated under a power of attorney of his wife by Chander Parkash.

Counsel for the petitioner has submitted that the wife of Chander Parkash does not have cordial relations with him and she has lodged a complaint against him for usurping her property. Be that as it TAPINDER SINGH MANN 2015.01.09 17:22 I attest to the accuracy and integrity of this document

Cr. Misc. M 43114 of 2014 may, it is apparent that the petitioner connived with his real brother to deprive the complainant of her property by identifying a wrong lady before the Sub Registrar.

Counsel for the petitioner, at this stage, has submitted that petitioner has undergone operation of brain tumor in the year 2006, as such, he may be granted the concession of pre-arrest bail. The said ground may constitute a good ground for grant of regular bail but no extra ordinary exceptional circumstances exist to grant the concession of pre-arrest bail to him.

Dismissed.
