This is the second petition filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.361, dated 13.09.2023, registered under Section 304-B IPC at Police Station City Hoshiarpur, District Hoshiarpur. 2.

Learned counsel for the petitioner submits that FIR is registered under Section 304-B IPC and ingredients of Section 304-B are not fulfilled. He further contends that the cause of death as per the opinion of the Board of Doctors, which is placed on record, is natural. 3.

On the other hand learned counsel for the State opposed the bail application and submits that the allegations levelled against the petitioner in the FIR are serious in nature. He further submits that instead of joining the investigation, the petitioner is moving the application dated 15.09.2023 before the police authorities regarding his false implication. I have heard learned counsel for the parties. 5.

A perusal of the FIR shows that there are direct allegations of harassment by the deceased against the petitioner who is her husband. Ramanpreet Kaur - deceased suffered brain stroke and paralytic attack and further still she used to face harassment by the husband and mother-in-law. And when the complainant went to meet his sister at Delhi she complained and levelled serious allegations against the husband Ajay Kumar Arora that they would kill her. After perusing the whole FIR and the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner. 6.

The present petition is dismissed accordingly. 7.
