Allowed as prayed for and the copy of copy of affidavit/ self declaration of complainant/respondent No.2 as Annexure P-3 is ordered to be taken on record.

The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of FIR No. 0122 dated 04.05.2021 under Sections 326/324/323/148/149 of IPC registered at Police Station Kamboj District Amritsar and all the subsequent proceedings arising out of the same qua the petitioners on the basis compromise (Annexure P-2). 2.

Learned counsel for the petitioners has placed reliance upon judgment passed by this Court in CRM-M-6890 of 2013 decided on 01.06.2018 titled as " Mangal Dass Gautam & another Vs. State of Haryana & another". 3.

Mr. Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of the respondent-State. Learned State counsel states that no other FIR has been registered against the petitioners and they have no known criminal antecedents. 5.

Mr. Balbir Singh Sewak, Advocate appears and accepts notice on behalf of respondent No.2. He has filed his memo of appearance in the Court today and the same is taken on record. He confirms the factum of the compromise having been effected between the parties and states that respondent No. 2 has no objection to the quashing of the FIR in question. 6.

In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 7.

Accordingly, the petition is allowed and FIR No. 0122 dated 04.05.2021 under Sections 326/324/323/148/149 of IPC registered at Police Station Kamboj District Amritsar and all the subsequent proceedings arising out of the same qua the petitioners on the basis compromise (Annexure P-2) shall stand quashed qua the petitioners subject to payment of Rs.5,000/- as costs to be paid to the High Court Legal Services Committee.
