CRM-M Nos. 21423 & 22011 of 2020 (O&M) - 2 - 1.

This order shall dispose of the above mentioned two petitions wherein petitioners Deepak Kumar @ Prince and Rajat Kumar, are seeking grant of anticipatory bail in a case registered vide FIR No.224, dated 17.12.2019, Police Station Chhachhrauli, District Yamuna Nagar, under Sections 323, 324, 427, 506, 326, 285 and 34 IPC (Sections 326 and 285 IPC added later on). 2.

At the time of issuance of notice of motion on 4.8.2020 in CRM-M21423-2020 the following order was passed :- "Today, at the very outset, the learned counsel for the petitioner has submitted that the parties have amicably resolved their issues and have entered into a compromise.

At this stage, Mr. Amit Khari, Advocate has put in appearance on behalf of the complainant and accepts notice on behalf of the complainant. He has endorsed the fact that the parties have entered into a compromise.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C." 3.

A similar order was passed in CRM-M-22011-2020 on 7.8.2020.

Ms. Vijay Lakshmi, who is appearing on behalf of the complainant has endorsed the fact that the parties have indeed entered into a compromise.

The learned State counsel has informed that pursuant to interim directions, both the petitioners have already joined investigation. 6.

Having regard to the facts and circumstances wherein the petitioners are stated to have compromised the matter and have already joined investigation, their custodial interrogation is not warranted. Both the petitions, as such, are accepted and the interim directions issued vide order dated 4.8.2020 passed in CRM-M-21423-2020 and order dated 7.8.2020 passed in CRM-M-22011-2020 are hereby made absolute subject to the condition that the petitioner shall appear and join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
