The petitioner has been in custody since 2.3.2014 for having been found in possession of 7 kgs of poppy husk and 1100 intoxicating tablets containing Diphenoxylate Hydrochloride (weighing 89.9 grams) against 50 grams of said salt, being commercial quantity as per the statute. It has been informed by the learned State counsel, on the instructions of ASI Pawan Kumar that 5 witnesses out of total 8 prosecution witnesses, stand already examined.

Taking into consideration the period of detention suffered by the petitioner and the recovery effected from him, I deem it appropriate to dispose of this petition with a direction to the prosecution agency to produce the entire prosecution evidence within a period of three months, after the next date of hearing fixed before the trial court. It is ordered that in case the prosecution agency fails to conclude the evidence within a period of three months after the next date of hearing, fixed before the trial court, the trial court shall release the petitioner on bail subject to his furnishing bail bonds/ surety bonds to its satisfaction.
