Present 2nd petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.31, dated 17.01.2024, under Sections 346, 302, 201, 365, 120-B of IPC (corresponding to sections 127(6), 103(1), 238, 140(3), 61(2) of BNS) [section 346 of IPC (coreresponding to section 127(6) of BNS was deleted later on], registered at Police Station Sector 8, District Faridabad. 2.

It is noticed that first regular bail petition filed by the petitioner, was dismissed as withdrawn, vide order dated 13.10.2025 passed in CRM-M-38135-2025 (Annexure P-8). Thereupon, complainant, who got registered the FIR, and one of the witness, i.e. PW-4 namely Raj Kumar in regard to the extrajudicial confession, have been examined. Further, 4th bail application filed by the petitioner before the trial Court, was dismissed, vide order dated 16.03.2026, wherein paragraph No.4 reads as under:- "Applicant is not named in the FIR, However, lateron, Rajkumar brother of the deceased Jitender named the applicant as coconspirator with the co-accused Rekha in the murder of his brother. It is the case of the prosecution that applicant was having illicit relation with Rekha (wife of deceased Jitender) and in conspiracy, they murdered Jitender. The call detail record and location of the mobile of the applicant/accused Jaivir and Rekha (wife of the deceased) shows that they are in continuous touch with each other from 01.01.2024 to 11.01.2024 when deceased was kidnapped and their location is found together with the deceased Jitender at village Iglas, District Aligarh (U.P.)

where he was murdered. The CCTV footage regarding the incident was also obtained and as per case of the prosecution, it shows presence of applicant, coaccused Rekha and deceased Jitender together at about 7.30 p.m. on 11.01.2024. Dead body of the deceased Jitender was also recovered from the canal of village Iglas, Aligarh (U.P.) The applicant got recovered the scooty used in the offence, which is also seen in the CCTV footage and this shows complicity of the applicant in the offence." 4.

Looking at the observations made in the order dated 16.03.2026 passed by the Court below, this Court does not find any ground to grant the concession of regular bail to the petitioner in the present case. Hence, present petition is dismissed.
