Prayer made in the present petition is for quashing the order dated 12.08.2005, Annexure P-1, whereby the second promotional scale granted to the petitioner had been withdrawn, regarding which no interim order was passed.

Learned State counsel makes a reference to para 6 of the written statement on merits filed on behalf of the respondents to state that the respondent-PSEB Board has issued the instructions to withdraw Time Bound Promotional Scale in case any employee forgoes his actual promotion, which was appended as Annexure R-1, justifying the impugned order as he had submitted application to that effect from 26.08.2003, reproduced in para 29 of the reply. To the above facts, there was no rebuttal by filing any replication. 3.

In view of the above, the present petition is disposed of, reserving the petitioner with a liberty to get it revived, in case lis still survives.
