Petitioners have filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 34 dated 9.3.2012 under Section 420, 465, 468, 471, 474, 120-B of the Indian Penal Code, 1860, registered at Police Station City Kharar, District Mohali.
Heard.
Vide order dated 3.5.2013, arrest of the petitioners was stayed.
Today, learned State counsel has placed on record affidavit of Deputy Superintendent of Police, Kharar wherein it has been stated that the petitioners have joined investigation and their custody was not required as all the facts were already on record and the investigation of the case was already complete. In view of the said affidavit, this petition is allowed.
