RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner in a case arising from FIR No.269 dated 27.05.2008 registered under Sections 394, 307, 473, 201 and 397 IPC and Section 25 of the Arms Act, 1959 at Police Station Sector 5, Panchkula.

According to the prosecution, on 27.05.2008, petitioner along with his three accomplice committed daylight robbery in muffled faces and robbed complainant Rajesh Kumar and his cousin Dharamvir for `7.00 lakh. Learned counsel for the petitioner inter alia contends that petitioner was arrested on 28.10.2017 i.e. after 09 years and 05 months of the alleged occurrence. Complainant and his cousin as PW4 Rajesh Kumar and PW5 Dharamvir, respectively, have not supported the prosecution case as they did not identify the petitioner. No recovery has to be effected from the petitioner. -2CRM-M-44125 of 2018 in eight cases. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
