Mr. Sandeep Kumar Yadav, Advocate for the petitioners.
Ms. Ankita Ahuja, AAG, Haryana.
Ms. Deepika, Advocate for respondent Nos.2 & 3. **** H.S. GREWAL, J. (ORAL) CRM-25925-2025 Allowed as prayed for and copies of affidavit of the complainant as well as of injured (Annexures A-1 & A-2) in support of the compromise, are taken on record.
Main case 1.
By way of this petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the petitioners seek quashing of FIR No.563 dated 12.12.2024 under Sections 115, 126, 190, 191(2), 351(3) of BNS, 2023 registered at Police Station City Narnaul, District Mahendergarh alongwith all consequential proceedings arising therefrom on the basis of compromise dated 29.03.2025 (Annexure P-2).
CRM-M-20466-2025(O&M) -22.
Notice of motion.
3.
Ms. Ankita Ahuja, AAG, Haryana, accepts notice on behalf of the respondent-State.
4.
Learned counsel for respondent Nos.2 & 3 confirms the factum of the compromise having been effected between the parties and states that respondents have no objection to the quashing of FIR in question. She has placed on record the original affidavit of the complainant and the injured which are taken on record.
5.
Learned State counsel has stated no objection in case the FIR is quashed based upon the compromise. He further states that the petitioners are not involved in any other case.
6.
I have heard learned counsel for the parties and perused the material placed on record.
8.
In view of the above, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences, therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 9.
Accordingly, the petition is allowed and FIR No.563 dated 12.12.202 under Sections 115, 126, 190, 191(2), 351(3) of BNS, 2023 registered at Police Station City Narnaul, District Mahendergarh alongwith all consequential proceedings arising therefrom are quashed qua the petitioners subject to payment of costs of Rs.5,000/- each, to be paid to the High Court Legal Services Committee.
CRM-M-20466-2025(O&M) -310.
Needless to say that the parties shall remain bound by the terms of compromise.
