RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video-conferencing due to Covid-19 pandemic.
Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Arun - in case arising from FIR No.0141 dated 18.02.2020 registered under Sections 323, 506 IPC (Sections 324 and 326 IPC added later on) at Police Station Chandni Bagh, District Panipat.
According to prosecution, in the morning of 10.02.2020, petitioner gave beatings to his wife Renu (complainant) and knife blow on her left ear, forehead and other parts of her body. Learned counsel inter alia contends that petitioner has falsely been implicated in this case. Petitioner is innocent. -2CRM-M-21484 of 2020 presence on the spot at the time of alleged occurrence. There is inordinate delay of eight days in lodging the FIR. Petitioner is in custody since 28.02.2020. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Arun - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
