The present petition has been filed under Section 438 Cr.P.C. seeking concession of anticipatory bail to the petitioner in case F.I.R. No.201 dated 16.10.2015 under sections 148/149/323/325/285/506/307/341 IPC and Sections 25/54/59 of the Arms Act, registered at Police Station Hassanpur, District Palwal.
It is a matter where this Court would not be required to go into the merits. The petition is opposed on the ground that the petitioner is a habitual offender and a list of 7 other FIRs in which the petitioner is involved had been furnished to this Court on the last date of hearing. During the course of resumed hearing today, counsel for the petitioner has not been able to rebut the factual position as regards the involvement of the petitioner in a number of other criminal proceedings including FIR No.170 dated 02.11.2013, under Sections 302/201/345 IPC registered at Police Station Hasanpur, District Palwal. Under such circumstances, petitioner is not held entitled to the concession of pre-arrest bail.
Petition dismissed.
