**** SANJAY VASHISTH, J. (Oral) 1.

Present Regular Second Appeal (RSA) has been filed by the defendant (appellant herein) against the concurrent finding of decretal of suit filed by the plaintiff.

Mr. Pankaj Bali, learned counsel for the appellant (defendant) submits that the defendant - Satpal is related as brother-in-law/Jeeja of the plaintiff. Suit for possession with consequential relief of permanent injunction has been decreed by Ld. Trial Court, and thereafter, appeal filed by the defendant has also been dismissed.

Learned counsel further submits that during the pendency of the present appeal, the decree has been satisfied, as the possession has also been delivered to the decree-holder (plaintiff). He also submits that he has got required instructions from the appellant (defendant) to not to pursue the present appeal before this Court.

Learned counsel submits that let the present appeal be allowed to be withdrawn.
