(ORAL) At the very outset, learned senior counsel for the petitioner submits that the relief sought has been confined to a limited prayernamely, for the issuance of directions to the learned Special Judge, S.B.S. Nagar, to decide the application dated 29.07.2022 filed in CIS No.PC-02-2021 arising out of FIR No.140 dated 02.06.2021 registered at Police Station City Nawanshahr. By way of the said application, the petitioner has sought transposition of the complainant as an accused, in light of certain self-incriminating statements attributed to him.

It is further submitted that, the trial having proceeded, no order has yet been passed by the learned Court on the said application. The learned senior counsel submits that the petitioner would be satisfied if an appropriate direction is issued to the learned trial Court for expeditious adjudication of the application dated 29.07.2022 annexed as Annexure P-8.

In view of the limited prayer made by the learned senior counsel for the petitioner, the instant petition is disposed of with directions to the learned Special Judge, S.B.S. Nagar, to decide the application dated 29.07.2022 (Annexure P-8) positively within the next one month, in accordance with law.
