PANKAJ JAIN, J. (ORAL) On 08.05.2023, the following order was passed :- "Prayer is for grant of anticipatory bail to the petitioner in criminal case having FIR No.59 dated 17.3.2023 registered under Sections 25 of Arms Act at Police Station Bhiwani Civil Lines, District Bhiwani.

Counsel for the petitioner inter alia contends that the petitioner was not named in the FIR and later on, named as accused on the basis of the disclosure statement alleged to be made by co-accused Sunil and Sonu. He further submits that relevance and veracity of the alleged disclosure statement made by co-accused will be tested during trial and similarly situated co-accused Ravinder is already granted concession of interim bail by this Court vide order dated 26.4.2023 in CRM-M-205472023. Counsel for the petitioner further submits that in all other criminal cases faced by the petitioner, he is enlarged on bail. Notice of motion.

Mr. Naveen Kumar Sheoran, DAG, Haryana accepts notice on behalf of the State and on instructions from ASI Sanjay Kumar submits that co-accused Sunil and Sonu were arrested by DEEPAK KUMAR 2023.08.10 09:18 I attest to the accuracy and integrity of this document

CRM-M-22925-2023 -2-   the police along with two country made pistols and 5 live cartridges each and during investigation, aforesaid Sonu disclosed that said firearms and ammunition were purchased from the petitioner and Ravinder. He further apprised the Court that the petitioner is a habitual offender and is having large number of other criminal cases. State counsel has not disputed the fact that co-accused

Today, Ld. State Counsel on instructions from ASI Sanjay Kumar submits that the petitioner has already joined investigation and is no more required for custodial interrogation.

Without commenting on the merits of the case and in view of the aforesaid fact, order dated 08.05.2023 is made absolute, subject to the conditions as enumerated under Sections 438(2) Cr.P.C. 4.

The petitions stands disposed off.
