Learned counsel submits that name of the petitioner surfaced based on the disclosure statement of co-accused Pushpa from whom alleged noncommercial quantity of contraband, it being 6 grams 240 milligrams of heroin was recovered. There is no evidence of his involvement with regard to the aforesaid recovery. He relies on the judgment passed by Hon'ble The Supreme Court in the case of Toofan Singh Vs. State of Tamil Nadu, 2021 (1) RCR (Criminal) 1. He is not involved in any other case. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.
Notice of motion.
At the asking of the Court, Mr. BS Saroha, DAG, Haryana, accepts notice on behalf of respondent-State. Meanwhile, the petitioner is directed to join the investigation on or before 16.04.2026. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) BNSS.
