Prayer in the present Civil Writ Petition under Article 226 of the Constitution of India is for issuance of directions to the respondents to restore the Basic Pay of the petitioner by allowing him restoration of decrements in terms of Paragraph 11A of the General Insurance (Rationalization of Pay Scales and Others Conditions of Service of Development Staff) Scheme 1976, read with recommendations already made by respondent No.2 vide letter dated 09.02.2016 (Annexure P-5). Learned counsel for the petitioner would contend that in this regard a notice of demand dated 12.02.2021 (Annexure P-16) has been sent to the respondents. However, no action/decision has been taken qua the same. Leaned counsel for the petitioner would further contend that he limits his prayer in the present case and would be satisfied if a direction is issued to respondent No.2 to take a time-bound decision on the notice of demand dated 12.02.2021 (Annexure P-16) raised by the petitioner. Without commenting upon the merits of the case and in view of the limited prayer made by learned counsel for the petitioner, the present writ petition is disposed off with a direction to respondent No.2 to take a decision qua the notice of demand dated 12.02.2021 (Annexure P-16), in accordance with law, expeditiously and in any case within a period of two months from the date of receipt of a certified copy of this order. Disposed off accordingly.
