(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No.77 dated 23.06.2017 under Sections 323/325 and 341 IPC read with Section 34 IPC (Section 307 IPC added later on) at Police Station Behal, District Bhiwani.

Learned counsel for the State submits that petitioner No.2 has surrendered before the investigating agency and is in custody at present. As regards petitioner Nos. 1 and 3, they have joined investigation pursuant to order dated December 14, 2017 and are no longer required for custodial interrogation.

In view of the above, order dated December 14, 2017, is hereby made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.

Disposed of.
