(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.152, dated 09.04.2019, under Sections 323, 34, 427, 452 and 506 IPC, Police Station Pataudi, District Gurugram. According to the prosecution, in the morning of 08.04.2019, the petitioners after marking their attendance left their employer's premises without any intimation, because earlier they were asked to deposit `1,30,000/- belonging to their employer's company, which was not deposited by them. Thereafter, around 2:30 p.m., both the petitioners along with their accomplice returned to their employer's company under the influence of liquor, armed with dandas and created nuisance. CRM-M-20698-2019 --2-- the company namely, Lokesh with dire consequences. Learned counsel contends that petitioner No.2 received multiple injuries at the hands of complainant-Parveen. Both the petitioners have falsely been implicated. No recovery has to be effected from them. All other offences except Section 452 IPC are bailable. Ingredients of Section 452 IPC are not fulfilled, as the premises, where the alleged occurrence took place is the work place of the petitioners. Considering overall facts and circumstances, instant petition for anticipatory bail is dismissed.
