Through this petition under Section 439 Cr.P.C., petitionerVivek @ Vicky @ Vicka, has prayed for grant of regular bail in case FIR No. 07 dated 04.01.2020 registered under Sections 379B and 120-B read with Section 34 IPC at Police Station City Bahadurgarh, District Jhajjar, Haryana.

According to prosecution, in the night of 01.01.2020 around 7.30 p.m., petitioner along with his accomplice snatched the mobile phone of complainant-Ravi Ranjan Pandey, showing him knife. Learned counsel for the petitioner inter alia contends that petitioner has falsely been implicated in the instant case. Nothing has been recovered from him. Petitioner is in custody since 05.01.2020. CRM-M-21535-2020 -2Conclusion of trial may take long time. No useful purpose would be served by detaining him in jail. Co-accused of petitioner, namely; Saurabh, has already been enlarged on bail by this Court vide order dated 30.07.2020, passed in CRM-M-18480-2020. Thus, treating the case of petitioner on the same parity, he may also be granted regular bail. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Vivek @ Vicky @ Vicka, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
