******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 750 dated 02.10.2015 registered for offences punishable under Sections 392, 394, 427, 341, 323 read with Section 34 of Indian Penal Code (for short 'IPC'), at Police Station Sirsa City, District Sirsa. Heard.
The petitioner absented on 15.03.2016 and thereafter, he was declared proclaimed offender vide order dated 13.10.2016. Learned State counsel submits that as per instructions received by her, the petitioner has already surrendered before the trial Court and has been released on interim bail under order dated 12.12.2016 passed in this petition.
In view of above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 12.12.2016 is made absolute on his furnishing undertaking before trial Court that he will Jitender Kumar 2017.02.18 11:59 I attest to the accuracy and integrity of this document CHANDIGARH
