Present:

Mr. Balkar Singh, Advocate for the petitioners. HARINDER SINGH SIDHU, J The present petition has been filed under Article 226/227 of the Constitution seeking direction to respondent Nos.1 to 3 to provide protection to the lives and liberty of the petitioners at the hands of private respondent Nos.4 to 7.

It has been averred that petitioner No.1 is aged about 22 years while petitioner No.2 is about 31 years old. Copies of Aadhar Cards of petitioner Nos.1 & 2 to this effect are attached as Annexures P-1 and P-2 respectively.

It has been submitted that petitioner No.1 was earlier married with respondent No.4. There is one child from the said wedlock. Petitioner No.2 was married with one Urmila in the year 2013. There are two children from the said wedlock.

It is the case of the petitioner that both of them are now living separately from their previous partners because of matrimonial dispute between them. From the last five months, the petitioners are living together. They apprehend danger to their lives at the hands of private respondents. CRWP No.6265 of 2021 #2# In this regard, the petitioners have submitted representation dated 05.07.2021 (Annexure P-3) to respondent No.2 seeking protection of their lives and liberty at the hands of the private respondents. After hearing counsel for the petitioners and without expressing any opinion on the merits of the case or the status of legal relationship of the petitioners and the age of the petitioners, the present petition is disposed of with direction to respondent No.2 to look into the said representation with regard to safeguarding life and liberty of the petitioners and take necessary action as may be necessary, in accordance with law. By way of abundant caution, it is clarified that this order is limited to protection of life and liberty of the petitioners.

It does not and cannot confer immunity to the petitioners from any legal action at the hands of their spouses and their obligations/responsibilities arising out of their subsisting marriages.
