(ORAL) Learned counsel for the petitioner submits that petitioner No. 2 is working in Defence Services of Government of Australia and he would be landing to India on 18.10.2022 and would be returning back from India on 20.11.2022. He further submits that he be permitted to surrender before the concerned Court and on which date he shall be released on bail and trial be completed within a short span. Given the facts that petitioner No. 2 is serving in Defence Services in Australia, the present petition is allowed subject to payment of costs of rupees ten thousand each to be deposited by the petitioners in the following account and hand over its receipt to the trial court.

It is further clarified that trial is expedited and trial Court is directed to complete the trial on day to day basis subject to the petitioners shall not abstain even on a single date. The complainant is presented through a counsel in this Court is also directed to appear before such date. Considering the entirety of the facts and more particularly that petitioner No. 2 is serving in Defence Services in Australia. It is clarified that in case petitioner fails to appear for any unjustifiable causes i.e. illness and delay in flight, this order shall stand recalled.
