Petitioners have filed this petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of cross case registered against them under under Section 308, 323, 324, 341, 148, 149 of the Indian Penal Code, 1860 ('IPC' for short) in FIR No. 195 dated 26.11.2012 under Section 307, 323, 324, 341, 148, 149 IPC, registered at Police Station Shahkot, District Jalandhar (Annexure P-1) and all the subsequent proceedings arising therefrom including the order dated 1.9.2014 (Annexure P-5).
Heard.
Petitioners were declared proclaimed offenders vide order dated 1.9.2014 (Annexure P-5). Petitioners have placed reliance on compromise dated 12.1.2013/16.1.2013 (Annexure P-3). However, earlier petition filed by the petitioners, seeking quashing of the cross-version against them on the basis of compromise Annexure P-3, was dismissed by this Court vide GURPREET SINGH 2015.12.24 10:51 I attest to the accuracy and authenticity of this document chandigarh
Crl. Misc. No. M-43260 of 2015 (O&M) -2 - order dated 19.2.2015 as the terms of the compromise had not materialized. There is no new compromise effected between the parties on record. Although, the accused who had faced trial have since been acquitted by the Trial Court vide order dated 28.8.2015 (Annexure P-6) but no interference by this Court is called for as the petitioners were declared proclaimed offenders. Dismissed.
