(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner in case FIR No. 19 dated 12.01.2019 registered under Section 306 read with Section 34 IPC at Police Station Meham, District Rohtak. According to the prosecution, petitioner was married with Virender (deceased), who committed suicide within 6-7 months of marriage, leaving behind two suicide notes levelling allegations of harassment, at the hands of petitioner.
Learned counsel inter alia contends that petitioner has falsely been implicated in the instant case. In fact, deceased was impotent, therefore, under inferiority complex, being not able to fulfill matrimonial obligations, had committed suicide. No recovery has to be effected from the petitioner.
Considering the two suicide notes in which the deceased named the petitioner as responsible for his suicidal death and further that RISHU KATARIA 2019.05.13 16:12 I attest to the accuracy and integrity of this document
CRM-M-21338-2019 -2the deceased had committed suicide within 6-7 months of marriage with the petitioner, this Court is of the firm view that custodial interrogation of the petitioner is required to unearth the truth about suicide of her husband.
