By way of present petition filed u/s 483(3) of BNSS, 2023 (corresponding Section 439(2) Cr.P.C.), petitioner - Kushdeep Singh, is seeking cancellation of pre-arrest bail granted to respondent No.2 by learned Additional District & Sessions Judge, Mohali, vide its order dated 24.07.2024, in FIR No.158, dated 18.06.2024, u/s 420, 406, 120-B IPC, registered at P.S. Kharar, District Mohali.

The assailed order dated 24.07.2024 (P-4), passed by the Court of learned Additional District & Sessions Judge, SAS Nagar, says as under:- "Present :

Sh. G.S.Ghuman Advocate, counsel for applicant/accused. Sh. R.S.Jauhal , Addl. PP for State.

Complainant in person.

Arguments heard on the pre arrest bail application filed by applicant in case FIR no. 158 dated 18.06.2024, under Section 406,420 and 120 B IPC, PS Kharar.

Parties have effected compromise in the mediation Center. Copy of compromise has been placed on record. The arrest of the petitioner was stayed vide interim order dated 27.06.2024. In view of the compromise effected between the parties, interim order dated 27.06.2024 is made absolute. Applicant shall join the investigation as and when called by the Investigating officer on furnishing notice under Section 160 Cr.PC and subject to the compliance of provisions of Section 438(2) Cr.P.C. Counsel for the petitioner submits that after compromising the matter before the Mediation Centre at SAS Nagar, respondent No.2 has not adhered to the terms recorded therein.

Such a plea cannot be raised directly before this Court through instant petition, and after realizing this, counsel for the petitioner seeks withdrawal of the present petition to enable him to take appropriate steps in accordance with law for moving an appropriate application. Dismissed as withdrawn with liberty, as sought and recorded here-above.
