The petitioner seeks direction for transfer of the investigation in a case which was registered on the basis of an incident of assault dated 24.6.2015 by Puran Chand and others besides protection of protection of his life and liberty. Expressing grievance, a representation has already been submitted to the Senior Superintendent of Police, Faridkot. Notice of motion to Advocate General, Punjab. On asking of the Court, notice has been accepted by Ms.Harpreet Kaur Athwal, DAG., Punjab, present in the Court. Copy given.

This petition is disposed of with a direction that the investigation in the case registered at the instance of petitioner would be supervised by an officer not below the rank of the Deputy

CRM-M-43278-2015 (O&M) Superintendent of Police and the grievance of the petitioner will be appreciated to a logical end. In case of any threat to the life and liberty of the petitioner or apprehending breach of peace, necessary action may be taken on the basis of the allegations in the representation Annexure P2. It is further made clear that the basis for issuing instructions in the present case is to enable the Investigating Officer to arrive at a fair and just conclusion regarding the allegations. It will always be open to the Investigating Agency to take appropriate action or to file the complaint in case the allegations are found to be baseless and not supported by any relevant/admissible evidence. It will be appreciated in case necessary action is taken within period of two months after the receipt of a copy of this order. (M.M.S. BEDI) December 21, 2015.
