The petitioner was granted ante dated promotion in the Rank of Sub-Inspector w.e.f. 27.07.1990, whereas, he was actually promoted w.e.f. 02.12.1995. He was further promoted as Inspector w.e.f. 06.10.1999 vide order dated 14.03.2001. He is claiming differential amount of salary for the period from 27.07.1990 to 01.12.1995 (as Sub Inspector) and for the period from 06.10.1999 to 13.03.2001 (as Inspector).

The petitioner concededly did not discharge duties of Sub Inspector from 27.07.1990 to 01.12.1995 and Inspector from 06.10.1999 to 13.03.2001. As he had not discharged duties of higher rank and was granted ante dated promotion, he is not entitled to salary of higher rank.
