RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through this petition under Section 439 Cr.P.C., petitionerGurpreet Singh @ Juj, has prayed for grant of regular bail in case FIR No. 55 dated 12.06.2019 registered under Sections 302, 323, 148 and 149 IPC at Police Station City Zira, District Ferozepur. According to prosecution, on 12.06.2019, petitioner armed with baseball along with his accomplice attacked the complainant party and one Sunil Kumar, died in the occurrence.

Learned counsel for the petitioner inter alia contends that petitioner has not given any injury to deceased-Sunil Kumar. He has attributed injury on the person of injured-Inderjit Singh, which was found simple in nature. Petitioner is in custody since 11.08.2019. CRM-M-21500-2020 -2trial may take long time. No useful purpose would be served by detaining him in jail. Co-accused of petitioner, namely; Karan Kumar @ Karandeep Kumar Sharma, has already been enlarged on bail by this Court vide order dated 31.07.2020, passed in CRM-M-18588-2020. Thus, treating the case of petitioner on the same parity, he may also be granted regular bail.

On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Gurpreet Singh @ Juj, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
