Present petition has been filed under Section 439 of the Code of Criminal Procedure (Cr.P.C.) for grant of concession of regular bail to the petitioner in case FIR No.657 dated 14.12.2020 registered under Section 379-B and 201 IPC, at Police Station Sector 32-33, Karnal, District Karnal. Learned counsel for the petitioner contends that the FIR was registered on the complaint of one Parmod, who had stated that on 11.12.2020 at about 3.10 P.M., complainant and his son had gone to Punjab National Bank, Sector-7, Main Market, Karnal in connection with some work. The complainant entered the bank while his son Rudrash went to the market. He was followed by a young man aged about 25/26 years who at knife point, tried to snatch the bag carried by the son of the complainant.

When he resisted, the young man succeeded in snatching the pass-book from the bag and fled away with another person who was waiting for him on his motor-cycle. The petitioner was arrested. He allegedly made disclosure statement admitting his involvement in the present case. He also RENU 2021.07.

CRM-M-26255 of 2021 -2allegedly disclosed that the pass-book which has been snatched by him was subsequently burnt.

Learned counsel for the petitioner submits that the petitioner has been falsely involved in this case. In fact the complainant and his son have got given affidavits that the petitioner was not involved in the snatching. He states that though the petitioner has been implicated in eight cases he is on bail in six cases. The petitioner is a labourer. The investigation of the case is complete. The petitioner is in custody since 04.02.2021.

In view of the above and keeping in mind the fact that the investigation of the case is complete and petitioner is in custody since 04.02.2021, no useful purpose would be served by keeping him behind the bars. Hence, petition is allowed. Petitioner - Rajat is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/ Duty Magistrate concerned.

It has come on record that the petitioner is involved in eight other cases of similar nature. It is made clear that in case the petitioner indulges in any similar activity while on bail, the prosecution agency will be at liberty to seek the cancellation of the order granting bail to the petitioner.
