Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.170 dated 01.10.2017 under Sections 452/323/354/506/509/ 34/325 IPC, registered at Police Station Model Town, Hoshiarpur. As per the allegations in the FIR, the present petitioner alongwith co-accused struck their Tempo with the cart (Rehri) belonging to the complainant. The said cart was parked in front of the house of the complainant. When the complainant protested, the present petitioner and his brother allegedly hurled filthy abuses. Four injuries were caused to the complainant. Injuries attributed to the present petitioner have resulted in fracture of 3rd and 4th rib of the complainant as reflected in the Medico Legal Report and the x-ray report, produced in Court by learned counsel for the State. CRM No.M-43361 of 2017 -2In view of the specific allegations against the petitioner, I do not find any ground to grant the concession of anticipatory bail to the petitioner. Accordingly, petition is dismissed.
It is clarified that none of the observations made hereinabove shall be construed to be a reflection on the merits of the case. The same are solely confined for the purpose of decision of the present petition. ( LISA GILL ) December 7 , 2017.
