This petition has been filed under Section 528 of BNSS for issuing directions to respondent No.1 to register an FIR against the private respondents on account of illegal occupation and encroachment over the property of the petitioners.

Learned counsel for the petitioners contends that the petitioner has preferred a representation/complaint dated 26.06.2023 (Annexure P-3) to Deputy Superintendent of Police, Dakha against the private respondents but no action has been taken so far. Learned counsel submits that he would be satisfied if directions are issued to Deputy Superintendent of Police, Dakha to look into his representation/complaint dated 26.06.2023 and take appropriate steps at the earliest.

Keeping in view the facts and circumstances of the case and the limited prayer made by the petitioner, the present petition is disposed of with a direction to Deputy Superintendent of Police, Dakha to consider and decide the representation/complaint dated 26.06.2023 (Annexure P-3) of the petitioner in accordance with law within a period of two months from the date of receipt of certified copy of this order.
