While the petitioner was declared a proclaimed offender, his co-accused after trial, have been acquitted in an FIR of assault of the year 2004. Being a proclaimed offender, the petitioner is not entitled to any indulgence but in view of the fact that injured having turned hostile on the basis of compromise and co-accused having been acquitted, an exception can be carved out as the petitioner has already put in appearance before the trial court.
The petition is allowed and interim order dated 7.1.2016 is hereby confirmed and the petitioner will remain on bail against the bail bonds already furnished subject to the condition that the petitioner will continue to appear before the trial court and will not absent himself without any sufficient cause. It will be open to the prosecution agency to present challan against the petitioner.
