(Oral) Learned counsel for the petitioner and respondent No.2 submit that during the pendency of this petition the entire dispute between the parties has been amicably resolved before the Mediation & Conciliation Centre of this Court. Settlement Agreement dated 28.03.2018 is attached with this file.

Parties have agreed that a petition under Section 13-B of the Hindu Marriage Act, 1955 shall be filed. Total sum of `80 lakhs including a sum of `05 lakhs already deposited in the proceedings in the present matter shall be remitted to respondent No.2 by the petitioner. Crl. Misc. No. M-43457 of 2017 (O&M) [ 2 ] It is directed that the sum of `05 lakhs filed in terms of order dated 22.11.2017 with the Registry of this Court be released to respondent No.2 qua adequate proof of identity.

In view of the settlement, learned counsel for respondent No.2 submits that the execution proceedings filed by his client shall be withdrawn.

In this view of the matter, it is submitted that the present petition has been rendered infructuous.
