Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Kashmir Singh, who has been booked for having committed the offences punishable under Sections 7 and 13 (2) of the Prevention of Corruption Act, 1988, in a case arising out of FIR No.19, dated 04.12.2014, registered at Police Station, Vigilance Bureau, Amritsar. Learned counsel contends that as per prosecution case, the petitioner, who was Executive Sales Officer of Punjab MEENU 2015.01.09 18:42 I attest to the accuracy and authenticity of this document chandigarh

CRM-M-43523-2014 (O&M) -2Agro Food Grain Corporation Limited, posted at Gurdaspur, was allegedly apprehended while taking bribe of `7,000/-. The recovery has already been effected and no custodial interrogation qua the petitioner is pending and as such, he is in the judicial custody from 06.12.2014.

Learned counsel for the State has not controverted the above arguments raised by the learned counsel for the petitioner.

After hearing the learned counsel for the parties and going through the material available on record, the present petition is allowed. Petitioner-Kashmir Singh son of Satpal Singh, resident of 6/16, Scheme No.1, Improvement Trust Colony, Batala Road, Gurdaspur, Tehsil and District Gurdaspur, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bail bond to the satisfaction of learned Chief Judicial Magistrate, Gurdaspur.
