(Oral) CM-1171-CWP-2026 The instant application has been filed under provisions of Order XXII Rule 3 of the Code of Civil Procedure, 1908 on behalf of the applicants seeking impleadment of legal heirs of sole proprietor of petitioner No.1, who is stated to have expired on 15.12.2017. It is stated in the application that the applicants are the widow and two daughters of the deceased proprietor Shri P.K. Sahrma and that they are the only surviving heirs. The application is duly supported by affidavits of Rowena Sharma, wife of late Shri P.K. Sharma, Shalini Sharma Choudhary & Priyanka Sharma, daughters of late Shri P.K. Sharma, as well as copy of death certificate of sole proprietor late Shri P.K. Sharma of petitioner No.1.

CWP-19561-2007 (O&M) ( 2 ) late Shri P.K. Sharma, Shalini Sharma Choudhary & Priyanka Sharma, daughters of late Shri P.K. Sharma are ordered to be impleaded as legal representatives of sole proprietor of petitioner No.1. The amended memo of parties annexed with the application is taken on record. CM-18683-CWP-2025 By way of filing the instant application, the applicant/petitioners seek permission to withdraw the main petition i.e. CWP-19561-2007, which stands admitted vide order dated 3.3.2009, on the ground that the matter has been amicably resolved amongst the parties. The application is duly supported by affidavit of the applicant - Rowena Sharma wife of late Shri P.K. Sharma.

In view of the specific prayer made by the applicant/petitioners for withdrawal of the main petition and in view of the reasons mentioned in the instant application, the same is allowed as prayed for and the main case i.e. CWP-19561-2007, which stands admitted vide order dated 3.3.2009, is preponed and is taken on board today and the main case itself is hereby dismissed as withdrawn.

Registry is, however, directed to transmit back the record of the Forum/Commission.
