On the asking of the Court, Mr. K.D.Sachdeva, Additional A.G. Punjab, accepts notice on behalf of the State. Learned counsel for the petitioner, at the very outset, seeks permission of the Court to withdraw the present petition with liberty to approach the learned trial court, because the earlier petition filed on behalf of the petitioner before the learned trial court was dismissed, despite the fact that it was not even listed. On the other hand, learned counsel for the State submits that statement of ASI Gurpal Singh, Police Station Smalsar, was recorded by the learned trial court.

Criminal Misc. No. M- 43526 of 2014 (O&M) By that as it may, petitioner is granted liberty to approach the learned trial court by moving a fresh application pointing out all the abovesaid peculiar circumstances and the learned trial court shall consider the bail application on merits.
