(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No.0434 dated 20.10.2017 under Sections 323, 34, 341 and 506 IPC and Section 3 of SC and the ST (Prevention of Atrocities) Act, 1989, at Police Station Sadar Sonipat.
In view of bar contained in Section 18 of the Act, petitioners are relegated to remedy of seeking regular bail before the trial court. If any such application is moved within 10 days from today, it shall be decided within a week thereafter. Trial court shall be at liberty to take into consideration compromise, if any, effected between the parties. Arrest of the petitioners shall remain stayed till the decision of the bail application. Disposed of.
