Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.382 dated 25.12.2006 under Sections 307, 353, 412, 148, 149, 186 IPC and Section 25 of the Arms Act, registered at Police Station Mujessar, District Faridabad. Notice of motion.

Mr.B.S.Virk, Deputy Advocate General, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that in the present case, the FIR is of 2006. Earlier the petitioner absconded from the process of law and was declared proclaimed offender. He has only been arrested on 03.11.2016 in Vineet Gulati 2017.12.08 14:21 I attest to the accuracy and authenticity of this document Chandigarh this case. If the petitioner is released on bail, there is every chance that he

Keeping in view the facts and circumstances of the present case, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.

However, as the petitioner is stated to have been in custody since 03.11.2016, therefore, the trial Court is directed to decide the case expeditiously by giving short adjournments and if required, even day to day adjournments. The Investigating Officer/SHO concerned is directed to produce the witnesses before the trial Court preferably on the next 2-3 dates.
